BEATING THE PC PARTY IN COURT ON A SLAPP!
In November of 2017, the Ontario PC Party sued Jim Karahalios, and his campaigns Axe the Carbon Tax and Take Back Our PC Party. It was an attempt to shut down Jim’s political advocacy and the voice of thousands of PC members across Ontario and to bankrupt Jim.
For 6 long weeks Jim fought the party in court tooth and nail. Finally, a couple of days before Christmas, the judge awarded Jim the victory as he dismissed the lawsuit as a SLAPP - strategic litigation against public participation.
In Ontario, the Kathleen Wynne Liberal government brought in “Anti-Slapp” legislation. It allows defendants to dismiss a lawsuit early in a proceeding if a judge sees it as an attempt to stifle political participation in matters of public interest.
This was the first time a citizen was sued by a political party. And the first time that Anti-Slapp legislation was used against a political party.
